Domestic workers or servants are subject to a special regime that only recognizes an uninterrupted rest of at least nine hours each day ; a weekly rest of thirty-six uninterrupted hours ; and two weeks of paid vacation each time they complete a year of service.
Our legislation literally addresses it as follows: Article 259 of the Labor Code:
"The employment contract of domestic workers is governed exclusively by the provisions of this Title . Art. 261: The work of domestic workers is not subject to any schedule, but they must enjoy, between two workdays, an uninterrupted rest of at least nine hours. Art. 262: Domestic workers enjoy the weekly rest established in Article 163. Art. 263: (Amended by Law No. 103-99, Official Gazette 10029 of November 15, 1999). Domestic workers are entitled to two weeks of paid vacation each time they complete one year of service , as well as the salary provided for in the first paragraph of Article 219 of this Code . PARAGRAPH: (Amended by Law No. 103-99, Official Gazette 10029 of November 15, 1999)."
In addition to the money paid, they are entitled to accommodation and food of standard quality; these benefits are estimated at 50% of the salary they receive.
The amount of the Christmas salary will be equal to the sum of money paid by the employer under Article 260 of this Code.
It should be noted that workers employed by a condominium owners ' association are not considered domestic workers.
